Access to and use of this ticket sales website imply knowledge and acceptance of the general terms and conditions of use and sale of https://mavidadbernabeu.com. Likewise, in the event of contradiction, doubt or omission, the general conditions of use and sale shall apply.

DEFINITIONS

For the purposes of these General Terms and Conditions of Contracting, the following terms shall be interpreted in accordance with the following definitions:

• GENERAL CONDITIONS: General Terms and Conditions of Contracting governing the contract with the CLIENT.
• SERVICES: Services offered by MAVIDAD BERNABÉU to the CLIENT for contracting through the website, aimed at facilitating the purchase of tickets for the MAVIDAD BERNABÉU event.
• CLIENT: User of the Website who contracts the services provided through it by MAVIDAD BERNABÉU.

By completing the purchase process, the CLIENT confirms that they are legally capable of performing such an operation, are over 16 years of age or have, at a minimum, authorization from their legal guardian.

SCOPE OF APPLICATION

These General Terms and Conditions apply to the purchase of tickets and, where applicable, to user registration provided by MAVIDAD BERNABÉU. The General Terms and Conditions shall be made available to Clients on the website https://mavidadbernabeu.com, with the legally required advance notice. Therefore, Clients are advised to read the General Terms and Conditions carefully before submitting their personal and purchase information to formalize the sale of tickets offered by MAVIDAD BERNABÉU.

Through the ticket sales website, users may purchase tickets in advance for the MAVIDAD BERNABÉU event. The advance ticket sales service is generally available 24 hours a day, 365 days a year. However, MAVIDAD BERNABÉU may suspend, temporarily or permanently, at any time and without prior notice, the advance sales service of all or part of the tickets for events organized by MAVIDAD BERNABÉU.

SALES PROCESS

The Client may purchase tickets through the Website by following the steps of the process, which consist of selecting the desired Products and quantity, making payment, and providing the necessary personal information to receive the purchase confirmation and ticket voucher, which will be sent electronically. Each step of the sales process is explained on the Website. The Client may review their order and make any necessary corrections before proceeding with payment.

At the time of purchase, the Client may review the current General Terms and Conditions of Sale and the Privacy Policy. Purchasing Products implies acceptance of both the Terms and the Privacy Policy.

PAYMENT

Products may be paid for using the electronic payment methods available on the Website. The Client shall bear any fees charged by their bank for transferring the payment amount to MAVIDAD BERNABÉU.

The Client may opt for a reduced rate using discount codes that must be entered on the Website. MAVIDAD BERNABÉU may request supporting documents to verify the Client’s entitlement to a reduced rate.

All purchases must be paid for immediately. MAVIDAD BERNABÉU reserves the right to deny or cancel an order if there are indications of fraud.

DELIVERY

Unless expressly stated otherwise on the Website, delivery of Products will always be carried out electronically via a purchase confirmation and ticket voucher sent to the email address provided by the Client. The Client is responsible for the accuracy of the provided email address and must ensure the proper functioning and security of the email program used to receive the Products. The risk of loss of the Products sent electronically passes to the Client upon delivery of the email to the Client’s email provider.

The Client will always receive a purchase confirmation email with a summary of the basic information. The Client is responsible for retaining this email. If the Client does not receive the confirmation email for the purchased Products, they must contact MAVIDAD BERNABÉU at hola@somosexperiences.com.

The ticket purchase confirmation contains a proof of access or a link to it. This proof of access, whether printed or displayed on a smartphone, entitles the Client to access MAVIDAD BERNABÉU.

Each ticket voucher or reservation code is unique and may not be modified, copied, or reused, unless expressly stated otherwise.

OTHER GENERAL TERMS

In accordance with applicable regulations on the sale of tickets for public shows and recreational activities, the right of withdrawal does not apply.

Once tickets are purchased, no changes, returns, or cancellations are permitted.

Due to technical, artistic, organizational, audiovisual, or production needs, MAVIDAD BERNABÉU reserves the right to reassign previously sold tickets and replace them with others of equal or higher category, or, if necessary, refund the amount.

For online purchases, users will receive their tickets via email in PDF format, which will be valid for accessing the corresponding event.

The only acceptable reason for a refund is the cancellation of the event before it begins or a substantial modification of the show. A change in cast or event characteristics will not be considered a substantial modification. Refunds, if applicable, may be issued in the form of vouchers. Service and/or management fees will not be refunded.

No right to refund arises if the event is suspended or modified after it has started due to force majeure.

MAVIDAD BERNABÉU reserves the right, for technical, artistic, or force majeure reasons, to modify the nature of the production, as well as the dates, times, programs, and performers announced.

MAVIDAD BERNABÉU prohibits the resale of tickets and only guarantees the authenticity of tickets purchased through official channels. Tickets purchased from unofficial or unauthorized sources will be considered invalid, without prejudice to any administrative or criminal liabilities.

CONTRACTING REQUIREMENTS

Personal Requirements: Contracting with MAVIDAD BERNABÉU is intended for end Clients over the age of 16 for personal use or for persons on whose behalf the Client is legally authorized to act. Wholesalers, agencies, distributors, and other professional intermediaries are excluded.

Other Requirements: To comply with the legal obligation imposed on all Information Society Service Providers to confirm the successful completion of a purchase, the Client must provide an email address during the contracting process.

MAVIDAD BERNABÉU will retain the electronic contract for two years and will send a copy to the address provided by the Client as confirmation of the purchase.

MAVIDAD BERNABÉU is at all times subject to compliance with Law 34/2002 of July 11, on Information Society Services and Electronic Commerce.

PERSONAL DATA PROCESSING

In accordance with Regulation (EU) 2016/679 Directive 95/46/EC General Data Protection Regulation (GDPR) and other applicable legislation, MAVIDAD BERNABÉU informs the Client that the personal data entered in this form will be included in its databases, of which it is the controller, and processed automatically for the purpose of managing and fulfilling the obligations arising from the purchase process and the provision of services.

These personal data will also be included in MAVIDAD BERNABÉU’s database for consultation in case of issues with the tickets or contracted services.

Nevertheless, data provided by users may be processed by MAVIDAD BERNABÉU as Data Controller, and will always be stored and processed within European territory.

Your data may also be processed by other group companies for the purpose of ticket payment management and processing, and will be shared with the following group company:

If forms are used to collect this data, user identification is presumed valid as the user voluntarily enters the data and is responsible for its accuracy. Refusal to provide mandatory data will result in the non-provision of the requested service or information. Optional data may also be provided to better deliver the requested service.

Purpose of Processing: MAVIDAD BERNABÉU may request personal data via various forms forming part of its database for the sole purpose of carrying out its activities.

By using MAVIDAD BERNABÉU’s forms and contact emails, you must give express consent via the relevant opt-in to process your data for the following purposes:

• Providing institutional and commercial information
• Sending information on events, publications, and commercial offers related to MAVIDAD BERNABÉU and entities with which it has collaboration agreements.

Legal Basis: Processing of your data for non-informational purposes is based on your consent given at the time of purchase. Processing for informational purposes is based on your consent to maintain continuous communication with MAVIDAD BERNABÉU.

MAVIDAD BERNABÉU, under its legitimate interest, may carry out data processing strictly necessary for internal website administration and statistical analysis of visits and user behavior.

Right to Withdraw Consent: You may withdraw your consent at any time, as well as exercise your rights of access, rectification, deletion, restriction, opposition, and data portability by sending an email to hola@somosexperiences.com with the following: full name, address for notification purposes, and the specific request, indicating “Data Protection” in the subject line. In accordance with Article 12.6 of the GDPR, identity verification will only be required if there is reasonable doubt. Copy of the ID will not be systematically requested.

Data Recipients: Only those necessary to provide the service. Outside these cases, MAVIDAD BERNABÉU will not disclose the data unless legally required by courts or public authorities.

Data Retention: Data will be retained for the time necessary based on the purpose for which they were collected. For informational purposes, data will be kept until deletion is requested.

MAVIDAD BERNABÉU reserves the right to amend this Privacy and Data Protection Policy to adapt to legal changes. We recommend reviewing it before each website access. However, user relationships established before any policy changes will be governed by the rules in force at the time of access, without prejudice to the GDPR.

APPLICABLE LAW AND JURISDICTION
